LEARNING OUTCOMES Marks: 10 After attempting this activity students will be able to; Understand the concept of litigation. Comprehend how to resolve conflict through litigation and its related advantages and disadvantages. THE STATE There are many ways to resolve conflicts including surrendering, running away, overpowering your opponent with violence, filing a lawsuit, etc. Dispute resolution processes can be divided into two main categories, negotiation and adjudication. In negotiation, the disputants decide the issue whereas in adjudication the neutral third party decides the issue. Lawsuit/Litigation is one of the kinds of adjudication. The litigation process starts with filing a complaint in court and typically resolved at a court trial before a judge or adjudicator. Baig Electronics and Paracha Electronics are immediate neighbors in an electronic market of a metropolitan city. Their owners had quarreled on a petty issue some time ago and the issue worsened and became difficult to resolve for both. Baig Electronics’ owner wants to resolve the conflict through negotiation or mediation whereas Paracha Electronics’ owner wants to resolve through the third party and filing a lawsuit against Baig Electronics. THE REQUIREMENT Being a student of Conflict Management subject, answer the following question; What are effective conflict resolution strategies to avoid litigation? Discuss at least 4 points/strategies. 4 Marks What will be the advantages of and disadvantages to Baig Electronics and Friends Electronics if they go for litigation to resolve the dispute? Discuss at least 2 each of the advantages and disadvantages of the litigation process. 6 Marks IMPORTANT: 24 hours extra / grace period after the due date is usually available to overcome uploading difficulties.
